Terms Of Service VGen

☆By commissioning me, you agree to all the terms listed below. Please make sure you’ve read and understood everything before placing an order.☆I reserve the right to decline any commissions.☆If uploading the finished commission, Credit must be provided—@ChocoboBear and the base artist (when buying a YCH).
I will also credit client(s) unless otherwise requested.
☆DO NOT use my art for anything AI or NFT related
☆DO NOT cut up the art for any reason (unless you have my permission)
☆DO NOT trace any art or base
☆DO NOT resell for more than what you purchased the art for. You may resell for the same or less as long as the purchaser agrees to my TOS and properly credits art.PAYMENTS
☆Payments must be made through VGen
☆You can pay with any currency since VGen will convert the currency automatically (I use USD on my end)
☆Either Full payment or 50% down payment is required before starting your commission (for more expensive services I provide). This is to ensure payment is set in place before starting so no time is wasted or suspicious activity on the client's side. The 50% down payment option is given to the client for the same insurance reasons.☆For more expensive services:
Payment plans are an option just let me know beforehand. you can pay over the course of 3, 6, or 12 months after a 50% down payment is made. If you stop the payment plan in the middle of the project all work on it will stop until payments resume.
☆Once I have completed/ delivered the work the payment is nonrefundableREVISIONS
☆Adjustments are made in the SKETCH stage. However, I will try to give periodic updates throughout each step to try and avoid any major revisions.☆Make sure you are sending me the correct reference you want drawn!
☆Revision policies may vary depending on which type of commission you are requesting, each listing will include their own policies for this on vgen.☆For YCH if there is an error in the character design on my part, I can change it free of charge.
☆However, if there are larger changes that were not specified/or in the references provided it will incur an additional fee.☆For Model/Rig items, Not YCH chibi items
If there are any major revisions, where I need to completely redo a step in the workflow process, and additional $50 charge will be issued to you per workflow step needing to be redone.☆ If there are multiple/excessive changes being made then it may result in your commission being pushed behind other orders and will end up making the commission take longer. Please keep that in mind when requesting multiple/heavy editing.DEADLINES AND DELIVERY
☆Please check the delivery date when I send the invoice to you!
☆Please check with me beforehand if you need it by a certain date so we can discuss a price, as I may have prior obligations that interfere with your preferred delivery date.☆Rush fees are +25%-100% of the total price (price can vary depending on when you need your commission completed by) (subject to availability)
☆Same-day delivery fee: +200% of the price of the commission after previous add-ons (subject to availability)☆Turnaround time can take anywhere from 1 week to a few months to complete, depending on number of commissions I have at the time and what service you have commissioned from me.
☆Deadlines are determined based on each client and will be adhered to. Unless there is an unavoidable major life event which will be communicated to you. ex.) hospital stays, family emergencies, or deaths in the family.☆YCH don't usually have a long wait time unless i have a lot of commission coming in.☆I usually put the information on how fast I'm working on commissions on my Trello☆If you want an ETA before placing a request or applying for the waitlist, you can check my queue and use that information to roughly calculate how long it would take to reach your spot.☆You will get an estimated time (the longest it would take) once your request is accepted.☆Final files will be sent digitally in PNG format unless you specify otherwise.USE
☆Personal use not selling anything (streaming, content creation, Png for streaming, socials, twitch emotes, profile pictures etc.) is included in your purchase.
☆Commercial use for merchandising will have a fee (selling anything physical or digital). Each listing will have an option to purchase commercial use; you may come back and purchase commercial use rights at a later time if you change your mind.MY USAGE
☆I will be able to use your commission as promotional content and portfolio work for future commissions.
☆Please inform me in the request form if you consent to WIPS (work in progress) social media posts while I'm working on your project, or if you'd rather me post WIPS and the finished project after the fact once your project is done.
☆Please do not say you drew the commissioned piece yourself 🥲REFUNDS
☆Deposits are Nonrefundable if the project is already in progress. (for services that require a deposit)☆If I have not started on your commission, you will be issued a refund and cancellation minus a 5% inconvenience fee.☆If I'm unable to complete the final project, or if there's any unreasonable delays you are entitled to a full refund.☆No refund for YCH commissions if I have already started, however if asked during the sketch phase you can receive a refund minus the 5% feeCOMMUNICATION
☆Will mostly be done through DMs (direct messages) on VGen, or your choice in social media.
☆You may reach me on twitter if need be, @ChocoboBear. However I am most active on Discord, so this is recommended as a quicker form of communication.
☆Feel free to ask any questions about the progress of your commission, I will try to update you to the best of my abilities throughout the process. These updates include low resolution, watermarked screenshots and/or videos. I will send these low resolutions watermarked updates to avoid and potential suspicious activity.
☆For any questions I may have I will contact the client through VGen or their preferred method.☆If uploading the finished commission, Credit must be provided—@ChocoboBear and the base artist (when buying a YCH).
